To break a tie between two candidates, the Commission on Elections (Comelec) said poll personnel can employ toss coin and drawing of lots.

“Breaking a tie is provided in the Omnibus Election Code. Ito po ay drawing of lots, palabunutan and kung sino ang mabunot, siyang panalo,” Comelec Commissioner Rene Sarmiento said.

Section 240 of Batas Pambansa Bilang 881, otherwise known as the Omnibus Election Code, provides for the drawing of lots in case of a tie of two or more electoral candidates garnering the same or equal highest number of votes, with the proclamation as winner of the candidate favored by luck.

On the other hand, Comelec Spokesman James Jimenez said if the tie is between two candidates, then toss coin is also allowed. “Puwede kung dalawa ang magkalaban.”

Some Barangay Board of Canvassers had used the method in cases where there is a tie between candidates for barangay and Sangguniang Kabataan elections.
