JINGGOY EVENS UP SCORE WITH PNOY: Now, the scores are even. Even if President Aquino managed to jail Sen. Jinggoy Estrada for plunder in connection with Jinggoy’s alleged misuse of his pork barrel funds, Jinggoy nevertheless managed to throw his own punches, devastatingly knocking out Aquino’s “disbursement acceleration program”.

Surely, it is just a matter of time before Aquino gets jailed himself for misuse of his own pork barrel funds, now that the Supreme Court’s 13 justices unanimously  declared his pork barrel funds, labeled as “disbursement acceleration program” or DAP, as illegal and contrary to the 1987 Constitution.

Removed of any legal and Constitutional bases, DAP constitutes plunder under Section 2, Republic Act 7080, and Section 12, Republic Act 7659. These two laws provide that a government official who acquires ill-gotten wealth amounting to not less than P50 million through conversion, misuse, or misappropriation of public funds, commits plunder.

DAP CONSTITUTES PLUNDER: Based on published reports, the Supreme Court declared as illegal and contrary to the Constitution the conversion, misuse, or misappropriation of funds from the executive department for the use of other branches of government under DAP, for purposes not authorized by the General Appropriations Act.

The tribunal in effect ruled that there was conversion, misuse or misappropriation of funds when it voided the following acts, under Aquino’s DAP:

“the withdrawal of unobligated allotments from the implementing agencies and the declaration of the withdrawn unobligated allotments and unreleased appropriations as savings prior to the end of the fiscal year and without complying with the statutory definition of savings contained in the General Appropriations Act.

“Cross-border transfers of savings of the executive department to offices outside the executive department, and funding of projects, activities, programs not covered by appropriations in the General Appropriations Act…”

DID PNOY FORGET “UTANG NA LOOB”? Can anyone explain to me what all of these things mean? Did not Malacanang seek the help of opposition senators Estrada, Juan Ponce Enrile and Bong Revilla, to oust Renato Corona as chief justice of the Supreme Court? And, if we are to believe Jinggoy, did not Malacanang even give millions to the three senators and to their colleagues in the Senate, by way of DAP, for ousting Corona?

So, how did it happen that Estrada, Revilla and Enrile, who obviously acceded to the ouster of Corona by voting against him, precisely in accordance with the wishes of Malacanang, are now being detained and/or prosecuted by the very same government that sought and received their help against the former chief justice?

What happened to the principles of “utang na loob” and “honor among thieves”? Gone down the drain? Did Aquino forget that he owed a debt of gratitude, as it were, to Jinggoy, Bong, and Johnny when they voted according to what he wanted against Corona? Or, Aquino had no feeling of “utang na loob” in favor of the three, precisely because they got rewarded with millions in DAP anyway?
