PNOY ORDERED MARWAN OPERATION—BOI REPORT: President Aquino was the one who gave the go-signal and allowed the execution of Oplan Exodus, or the police operation plan designed to capture and neutralize Malaysian terrorist Zulkifli bin Hir, who is otherwise known as Marwan, the Board of Inquiry (BOI) of the Philippine National Police (PNP) disclosed the other day in its report on the Marwan operation. The report is now known as “The Mamasapano Report”.

This explosive conclusion of the board confirms earlier accusations that the Marwan operation which the PNP Special Action Force (SAF) carried out on January 25, 2015 was actually ordered by Aquino himself, debunking in the process contrary claims by the Office of the President and by the President himself about his participation in the operation where 44 SAF officers and men were mercilessly killed by enemies of the State.

But, Aquino did not only give the go-signal and allowed the execution of Oplan Exodus after the concept of operations was presented to him by Director Special Action Force (SAF) Police Director Getulio Napenas, according to the BOI report. The Board also found Aquino of having committed several violations of existing laws and regulations, as well as legitimate orders of duly constituted authorities.

PNOY COMMITTED VIOLATIONS OF LAW IN OPLAN EXODUS: Here are the violations of Aquino in the Mamasapano operation, the BOI report said: “The President allowed the participation of the suspended Chief Philippine National Police (CPNP) Police Director General Alan Purisima in the planning and execution of Oplan Exodus despite the suspension order (against Purisima) of the Ombudsman.

“The President exercised his prerogative to deal directly with Napenas instead of (with the) Officer In Charge of the PNP (OIC PNP) Police Deputy Director General Leonardo Espina. While the President has the prerogative to deal directly with any of his subordinates, the act of dealing with Napenas instead of (with) OIC PNP Espina bypassed the established PNP Chain of Command.

“Under the Manual for PNP Fundamental Doctrine, the Chain of Command runs upward and downward. Such manual requires the commander to discharge his responsibilities through a Chain of Command.”

SUE ALL ERRING OFFICIALS, MILF—BOI: The BOI report also chided Purisima for violating the “preventive suspension order issued by the Ombusman when he participated in the planning and execution of Oplan Exodus. He also violated Special Order No. 9851 dated December 16, 2014 issued by PNP OIC Espina directing him and other suspended PNP officers `to cease and desist from performing the duties and functions of their respective offices…”

Based on the foregoing findings and conclusions, the BOI recommended the criminal and administrative prosecution “of relevant government officials, the MILF and other individuals.”

It said: “Where the facts of this Report indicate possible violations of existing laws and regulations, appropriate government agencies should pursue the investigation of the Mamasapano incident to determine to determine the criminal and/or administrative liabilities” of concerned officials and private individuals…”
