KAKAMPI MO ANG BATAS

BY Atty. BATAS MAURICIO

LIFE’S INSPIRATIONS: “… Jesus answered, `I am the way and the truth and the life. No one comes to the Father except through me.  If you really know me, you will know my Father as well. From now on, you do know him and have seen him’…” (Jesus, our God and Savior, in John 14:6, the Holy Bible).

SECOND TRAGEDY FOR VALENZUELA FIRE VICTIMS: A second tragedy seems to have afflicted the families of the 72 workers who perished in the fire that razed the Kentex factory in Valenzuela City the other day: it would seem their right to file cases to recover damages against the factory owners had been effectively botched by President Aquino’s Office of the President.

Why am I saying this? Well, simply because Communications Secretary Herminio Coloma Jr., using a supposed finding from Labor Secretary Rosalinda Baldoz,   already cleared the owners of the factory and said they were compliant with labor and safety standards set by the government (which means, technically, they cannot be sued for damages by the victims’ families anymore).

Wow. How did Coloma and Baldoz manage to arrive at the conclusion that Kentex has complied with labor and safety standards when no investigation has ever been conducted on the fire yet? Obviously, Coloma and Baldoz intended to protect the factory owners, at the expense of the fire victims and their families. The question is, why?

MALACANANG: FACTORY COMPLIANT WITH SAFETY RULES: So, alright, I will allow my readers here to be the judge. Here was what Coloma said, in an email to Malacanang reporters, including Radyo Agila’s Ludovico Somintac (my co-anchor in the daily 6 to 7 a.m. program at DZEC, 1062 kHz, “Tambalang Batas at Somintac”), who forwarded Coloma’s message to me:

“We are saddened by the fire that gutted a factory in Valenzuela City… that resulted in the death of many workers.  We have been informed by Secretary Rosalinda Baldoz that as per Department of Labor and Employment (DOLE) records, the firm (Kentex) was assessed to have been compliant with occupational safety requirements as of September 2014.

“DOLE is coordinating with the Bureau of Fire Protection in ascertaining if there had been violations of safety regulations so that proper accountability may be established According to DOLE, Kentex is a unionized company, with an existing safety committee, and that its workers are entitled to government mandated social security and workmen’s compensation benefits…”
