The decision of the Ombudsman’s office (Mindanao) meting a six-month suspension on then Talisayan Barangay Chairperson and now City Councilor Josephine Pareja in connection with a grave misconduct case filed against her by Ronilo M. Martinez, the school principal of Talisayan National High School, has sparked legal debate.

The case was filed when Pareja was then Tulungatung barangay chairperson, and the decision of the Ombudsman’s office finds her guilty of grave misconduct and suspend her for six months.

The question: Is the six-month suspension directed at Pareja’s position as barangay captain or as a councilor?

Observers say Pareja cannot be suspended as barangay captain precisely because she is no longer the barangay chief of Tulungatung. On the other hand, she cannot be suspended as councilor because the Ombudsman case has nothing to do with her being a member of the City Council.

Legal technicality?

Reportedly, Pareja’s legal counsel, Atty. Quirino Esguerra. is set to file a motion for reconsideration with the Ombudsman’s office.
