District I Congressman Celso L. Lobregat on Friday stressed that he strongly believes Joselito Macrohon, who landed on the number nine slot during the May 09, 2016 election for the Sangguniang Panglungsod First District, is the qualified person that must replace District I Councilor Charlie Mariano following the rule of succession.

In a press briefing called by Congressman Lobregat, he explained that under the Commission on Elections (Comelec) rule of succession it is the candidate who got the number 9 slot in the race for the City Council 1st District Election who is the one eligible to succeed Mariano.

“I am confident that the decision of Comelec, that is if allowed by law, the rule of succession will follow and the rule of succession means number nine,” Lobregat said in an interview.

The congressman pointed out that Mariano was disqualified and he was not even considered by the Comelec as a candidate.

“As far as Comelec is concerned Councilor Mariano was not even a candidate so how can he be a councilor? How can you replace somebody that is not supposed to be there?”Lobregat emphasized.

Mariano was recently disqualified by the Comelec because of his conviction on the violation of Batas Pambansa No.22 or the bouncing check law.

Lobregat added that if Mariano can get the Temporary Retraining Order (TRO), he will remain but if not, the council will have to remove him. “Si recivi el Sangguniang Panlungsod el official decision they will have no option but to remove him unless there is a TRO.”

As of press time, the Comelec city office has not issued any legal opinion on the possible replacement of Mariano.

Meanwhile, Lobregat said that he is saddened that Mariano is leaving the City Council as he consider the veteran councilor as a hardworking legislator and fiscalizer.

“Councilor Mariano is a passionate, hardworking and dedicated legislator. He contributed much for the betterment of Zamboanga City,” Lobregat stressed.

Macrohon, when asked by the reporters if he is willing to replace Mariano, said he will still think about it as there still many things to be considered.
