Zambo pursues fight for justice against 2013 siege perpetrators Print

The City Government of Zamboanga through Mayor Beng Climaco continues its fight for justice against members of the Moro National Liberation Front (MNLF) Chairman NurMisuari’s faction that perpetrated the infamous Zamboanga Siege in 2013.

This, after the City Legal Office, represented by Atty. Jesus C. Carbon Jr., filed yesterday a petitionfor Certiorari, Prohibition and Mandamus with prayer for the issuance of Preliminary Injunction and application for the issuance of Temporary Restraining Order(TRO) with the Supreme Court, seeking to restrain Presiding Judge Maria Rowena Modesto-San Pedro from proceeding with the scheduled arraignment on the amended information for sedition and pre-trial conference on March 20, 2018 which will result in the release of the 138 MNLF members on account of the Plea Bargaining Agreement entered into by and between the Panel of State Prosecutors and some of the accused without the consent of the petitioner; thus, constituting substantial and material invasion of the petitioner’s rights.

The city also asked the Supreme Court, after due consideration of the instant petition, to issue a Writ of Preliminary Injunction, enjoining the implementation of the assailed orders of March 7, 2018 and Feb. 12, 2018 by respondent judge in Criminal Cases Nos. 152737, 152738 and 152739 for ‘Philippine Act on Crimes Against International Humanitarian Law, Genocide and other Crimes Against Humanity” against Misuari and his followers.

Also prayed for are equitable writs of Certiorari and Mandamus; (a) declaring the assailed orders null and void, and making the preliminary injunction permanent; and (b) ordering the respondent judge to try the cases under the 13th Amended Information and the crimes therein charged.-(Vic Larato)
