Former Indigenous People’s Representative (IPR) Ismael Musa has filed a petition for certiorari and asked the court to restrain Councilor Tungkuh Hanapi from serving as IP representative in the City Council.

Musa’s petition is in response to a decision by the Court of Appeals deciding in favor of Hanapi’s appointment.

Musa called the court’s attention to what he believes is a grave abuse of discretion amounting to a lack of jurisdiction on the Court of Appeals in deciding in Hanapi’s favor.

Musa said that the CA upheld an earlier decision of the Regional Trial Court in dismissing his complaint for Declaration of Nullity filed on the Certificate of Affirmation and Certificate of Recognition of Tungkuh Hanapi.

The case stemmed from the issuance of Certificate of Affirmation and Certificate of Recognition to Tungkuh B. Hanapi on August 1. 2016.

This became the basis for the removal of Musa as IP Representative by respondents Vice Mayor Cesar Iturralde and City DILG Officer Mohammad Taha Arakama even as the latter’s appeal was still pending with the NCIP Central Office.  (Remus Ong)
