Regional Trial Court (RTC) Branch 14 Judge Reynerio Estacio yesterday ordered a top police official, who was cited for contempt of court, to pay a fine for defying the Writ of Habeas Corpus earlier issued by the court.

Cited for contempt of court and ordered to pay fine of P6,000 was Sr. Supt. Edgar C. Danao, chief of the Criminal Investigation and Detection Group-9 (CIDG-9) based in Camp Batalla, this city.

This came about after Danao failed to present last Wednesday the person of Jumli Orie, barangay captain of Bagbagon, Lantawan, Basilan despite receipt of court order.

Combined police, including CIDG-9, and military operatives have arrested Orie, an alleged Abu Sayyaf bandit, last July 12 in Barangay Cabunbata, Isabela City.

The Court has issued a Writ of Habeas Corpus last Tuesday after Orie, assisted by lawyer Quirino Esguerra, Jr. filed a petition for Habeas Corpus citing the barangay official was arrested without warrant and detained without lawful cause since July 12, 2012.

“Now therefore, you are hereby commanded to take and have the body of the aforementioned person before this Court on July 18, 2012 at 2:00 in the afternoon, and then and there to appear before this Court to show cause on the confinement and make due return of this Writ in accordance with Rule 102, Section 8, 10, 11 and other sections thereof, of the Rules of Court,” the Court order addressed to Danao stated.

However, Esguerra said Danao transported Orie to Manila last Wednesday morning (July 18, 2012) though he was ordered to present the person of the barangay official to the Court in the afternoon of the same day.

“Instead of presenting the person of Orie to the Court, they returned the writ,” Esguerra said, adding that under the Rules of Procedure “a detainee cannot be transported once you received the order.”

Esguerra said that Danao did not even appear before the Court yesterday afternoon to show cause why he should not be cited in contempt of court for defying the writ of habeas corpus earlier issued by the court.  — BG
