Mayor Celso Lobregat yesterday swore in Caridad Salazar as the acting chief of barangay Tolosa to ensure continuous operation of local governance.
This, in view of the temporary vacancy in the position left by elected Tolosa chairman Pedro Rodriguez, who, together with 3 kagawads and 2 others are under detention at the Sangali Police Station for alleged involvement in the murder o a mango farm owner January 30.
Mayor Lobregat motored to Tolosa yesterday morning together with Vice Mayor Cesar Iturralde and Councilors Abdurahan Nuno and Percival Ramos, DILG City Director Atty. Taha Arakama, City Poice OIC Director Col.  Edwin de Ocampo and Task Force Zamboanga Chief Col. Buenaventura Pascual to  dialogue with the residents in view of the controversy that some barangay officials are embroiled in.
Lobregat said delivery of barangay services should not be sacrificed because of the detention of the barangay chief and other officials, thus, the need for the assumption of an acting chairperson.

Salazar, the former barangay chief, is the number one kagawad of Tolosa and is mandated under section 46 of the Local Government Code (LGC) to automatically assume the post, according to DILG director Arakama.

Before assuming the post, Salazar shall take her oath of affirmation before an administering authority like Mayor Lobregat.

Atty.  Arakama  further stressed that refusal to assume office would make Salazar or the number one kagawad liable for administrative charges for dereliction of duty. “She can also be held liable criminally pursuant to Article 234 of the Revised Penal Code on refusal to discharge official functions”.
The DILG official said Salazar can’t waive her right or dutyto assume the post as it is against public policy.

During the pulong-pulong or dialogue, held at the Pangulayan Elementary School, the residents present voiced out certain comments and reactions concerning their present situation.
The residents, according to Mayor Lobregat request for additional police personnel to be stationed in the Tolosa area.

Councilor Nuno, who is president of the Liga ng mga Barangay in a message said the issue shouldbe resolved, as whatever happens in barangay Tolosa affects the other barangays in the city.
Initially, Salazar was hesitant to assume the post but later acceded after being informed of the legal impediments that she be facing if and when she refuses the same.

Present during the pulong-pulong were the remaining barangay kagawads—Rodelin de la Cruz, Eliza Quijano, Placido de los Reyes, Sangguniang Kabataan chair Catherine Salazar and barangay secretary Rey Christopher Quijano.

Meanwhile, Rodriguez and the 3 kagawads and 2 members of the barangay intelligence network (BIN) allegedly involved in the murder case, have availed of the 15-day waiver and have opted to be detained at the Sangali Police station.

The others detained are identified as Reynerio Galcing- second kagawad; Joseph Lazareno and Florante Mendoza and BIN members Joseph Nazareo and Rene Ferrer. — Sheila Covarrubias
